1. Scope
These General Terms and Conditions govern all passenger transport and transfer services provided by VIEhub.at (hereinafter referred to as the "Contractor") within Austria and to neighboring countries. Any terms and conditions of the customer (hereinafter referred to as the "Client") that deviate from these General Terms and Conditions shall not apply, even if the Contractor does not expressly object to them. Deviations from these terms require the prior written consent of the Contractor. By placing an order, the Client acknowledges and agrees to these General Terms and Conditions. A contract is concluded only upon confirmation of the booking by the Contractor.
2. Information Covered by the Privacy Policy
This Privacy Policy applies to personal data that we collect, use and process in connection with our services, including through our websites, booking systems and other digital services (collectively, the "Services"). This Privacy Policy does not apply to how third parties or users of our Services independently collect or process personal data. By booking a service with us, you agree that your personal data will be processed in accordance with this Privacy Policy.
3. Data Protection
The Contractor is committed to protecting the Client's personal data in accordance with applicable data protection laws, including the GDPR. Personal data is used solely for the purpose of processing bookings, providing services and improving service quality. Personal data will not be shared with third parties unless required by law or expressly authorized by the Client.
4. Booking and Taxi / Transfer Services – User Information
When using our Services or making a booking, we may collect the following information:
- Name and company name (if applicable)
- Email address and telephone number
- Billing and payment information
- Pickup and destination details
- Geographic location and technical data
In addition, technical and usage data may be collected, including:
- IP address
- Browser type and version
- Pages visited and interaction data
- Referral sources and exit links
- Support requests and communication metadata
This data is stored securely within our systems, including databases, log files and analytics tools.
5. Payment and Prices
Payment for the completed journey must be made immediately after the service has been provided, directly in the vehicle or as otherwise agreed. Accepted payment methods include cash (EUR) and common credit or debit cards. If card payment is selected but cannot be completed due to insufficient funds or technical issues, the amount must be paid in cash.
All stated prices are fixed prices, gross amounts and include statutory VAT. Prices are based on distance (zone or district) and vehicle size. Prices remain fixed unless the booking is changed.
6. Cancellation
The Client may cancel a booking at any time. The following cancellation fees apply:
Up to 24 hours before departure: 50% of the total price
Up to 12 hours before departure: 80% of the total price
Less than 12 hours before departure: 100% of the total price
7. Waiting Time
Waiting time may be charged at a rate of €10 per hour, unless otherwise agreed. For airport pickups, a waiting time of up to 30 minutes after the scheduled arrival time is included. Delays due to flight changes or other transport delays do not require prior notification by the Client.
The Contractor reserves the right to cancel airport pickups if subsequent bookings cannot be fulfilled in a timely manner. In such cases, the service is deemed rendered and the full amount will be charged.
8. Payment Terms
Invoices are payable immediately unless otherwise agreed. A payment period of 14 days applies. Payments are considered received when credited to the Contractor's account.
In the event of late payment, default interest of 5% above the base interest rate will be charged. The Client is responsible for all collection and legal costs incurred.
9. Obligations and Liability of the Contractor
The Contractor undertakes to provide services with due care and professional diligence. Liability exists only in cases of intent, gross negligence or breach of essential contractual obligations. Liability for injury to life, body or health is governed by statutory provisions. All vehicles are insured in accordance with applicable insurance regulations.
The Contractor is not liable for delays caused by traffic, weather, road closures, accidents or force majeure.
10. Duties and Liability of the Client
The Client must comply with all applicable laws and regulations. Smoking in vehicles is prohibited. The Client must ensure safe transport of children and must not endanger other passengers or property. Any damage caused by the Client or transported items is the Client's responsibility.
11. Information Obligations of the Client
The Client must provide accurate and complete information when placing a booking, including passenger details, pickup time and location, destination and transported items.
Incorrect or incomplete information releases the Contractor from liability. The Contractor may refuse transport or adjust the price if circumstances change.
12. Jurisdiction and Severability
Austrian law applies exclusively. Place of jurisdiction and place of performance is Vienna, Austria.
If any provision of these Terms is found to be invalid, the remaining provisions shall remain unaffected.
